Abstract

Legal protection for children as victims is an effort made by all levels of society to carry out legal protection. Children are the nation's next generation who have rights and obligations and are development capital that will maintain and sustain the development of the Indonesian nation. Children's rights are part of the human rights contained in the 1945 Constitution, which broadly states that the state guarantees and protects the rights of a child from violent discrimination. Therefore, Law Number 23 of 2014 was made as a form of child protection. In Article 1 Paragraph (2) of Law Number 23 of 2014 it states that child protection is all activities to guarantee and protect children and their rights so that they can grow, develop and participate optimally in accordance with human dignity, and receive protection. from violence and discrimination. Therefore, this study aims to find out the form of legal protection and the process of criminal sanction rules for perpetrators of children who are victims of sexual violence according to the perspective of Law No. 35 of 2014. The method used in this writing is normative juridical research method or library research method . The results of the study show that based on the Child Protection Act Number 35 of 2014 Article 20 it is stated that those who are obliged and responsible for implementing child protection are the state, government, community, family and parents. Then related to the criminal sanctions imposed on the perpetrators are sanctions in the form of imprisonment for a minimum of 5 (five) years and a maximum of 15 (fifteen) years and a maximum fine of Rp. 5,000,000,000.- (five billion rupiah).
