Abstract

Keywords: Implementation of the Agreement, Default, Settlement of Defaults The house (board) is a very basic need in human life. At first the community saw the house only as a means of shelter/shelter, but gradually the community's perception was increasingly eroded by the needs of the house as a symbol of welfare. Therefore, a financial institution is needed to provide financial assistance in the form of lending, especially in Mortgage (KPR). Bank Tabungan Negara (BTN) is a Bank appointed by the government to implement a housing loan program with a credit facility called the House of Ownership Credit for a Bank Tabungan Negara (BTN) as a program in the field of public housing. The Bank Tabungan Negara (BTN) has proven to contribute to the development of the State, The method of approach in writing this thesis is a sociological (empirical) juridical approach, which is a study that emphasizes the rules of the rule of law that apply to society where law is not only conceptualized as the whole of the principles and rules governing life in society, but also includes institutions institutions and the process of law enforcement in society. Empirical approach (sociological juridical) is intended as an effort to approach the problem under study with the nature of the law that is real or in accordance with the reality that lives in society.Data collection techniques are done by observation, interview and documentation. The informants in this study were Pimp. Bank Tabungan Negara (BTN) Kediri Branch and 5 BTN KPR Debtors. Based on the results of this study, it was found that the Procedure for the Implementation of the BTN Mortgage (KPR) Agreement consists of 3 (three) stages, namely the first stage is the interview stage between the debtor and the Bank (BTN), the second stage is the credit guidance stage, and the third stage the credit rescue stage. From this stage the agreement will be created between the two parties and give rise to the rights and obligations for each party. In the course of this BTN Mortgage (KPR) Agreement, there were obstacles in the form of defaults. In this case the Bank Tabungan Negara (BTN) grouped the factors causing the default of defaults into 2 (two), namely defaults that occur as a result of negligence on the part of the debtor and defaults that occur due to weak credit supervision from the bank.
