Abstract

Intellectual Property Right is a right that arises from the results of human thinking, which produces a product or process that is useful for humans. In his writing, the author explains how to find out the application of material civil law to the resolution of song copyright disputes carried out by an agency and the legal considerations of the panel of judges in the district court decision number: 7/Pdt.SusHAKI/Cipta/2019/PN Niaga Sby, and to find out what legal remedies can be taken by the creator if there is a violation of his musical creation. Dispute resolution can be carried out through two channels, namely the court route and the non-court route or what is known as Alternative Dispute Resolution (APS). APS namely Law Number 30 of 1999 concerning arbitration and Alternative Dispute Resolution. Legal remedies that can be taken by creators in the event of a violation of their copyrighted work are through preventive and repressive measures. Prevention efforts that can be carried out by creators include registering copyrighted works so that later they will receive legal protection and legal certainty regarding the rights to their creations. As well as repressive efforts through civil law and criminal law. Key Word: Disputes, Copyright, Civil, Judge's Decision
