Abstract

This thesis focuses on the application of restorative justice in the resolution of juvenile criminal cases, with a particular emphasis on the case study of Decision Number 8/Pid.Sus-Anak/2021/PN.Slr from the Selayar District Court. Restorative justice is presented as an alternative to the conventional punitive approach, aiming to provide a more educational, humane, and reconciliatory resolution that seeks to restore the relationships among the offender, the victim, and the community. Employing a normative juridical method combined with a case study approach, this research analyzes the legal foundations, principles, and implementation of restorative justice for juvenile offenders, specifically in relation to Article 170 of the Indonesian Criminal Code (KUHP) concerning acts of assault VIII committed jointly. The findings reveal that in this case, the judge opted not to impose a prison sentence on the juvenile offender, but instead issued a sanction in the form of community service. This decision reflects the principle of the best interests of the child, as stipulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The judge’s considerations included the age of the offender, psychological condition, the child’s confession and remorse, and the victim’s willingness to forgive. This study concludes that restorative justice, when implemented collaboratively by law enforcement authorities, families, and the community, offers a more equitable and recovery-oriented alternative to traditional punitive measures, shifting the focus from retribution to rehabilitation.
