Abstract

The development of the internet is currently experiencing very rapid changes in people’s lives and causing many crimes that cannot be separated from the development of society. One of the crimes that often occurs on social media is cyberbullying. Social media such of facebook, instagram and other digital media are one of the places for perpetrators to commit this crime. Cyberbullying is currently often considired trival in society even though this crime has a bad impact on the victim. The purpose of this study is to find out and analyze the legal regulations regarding the crime of cyberbullying and to find out the legal protection for victims of cyberbullying. This type of research is normative juridical with a statuory approach and a case approach. The legal materials of this study consist of primary legal materials, secondary legal materials, and tertiary legal materials. The legal regulations for the crime of cyberbullying are regulated in the Criminal Code an the ITE Law. If the perpetrator of cyberbullying commits the crime verbally or is directed directly at someone can be subject to article 315 of the Criminal Code, while if someone uses social media as a place for the perpetrator to commit the crime, someone can be subject to article 27 paragraph 1 in conjunction with article 45 paragraph 1 of Law Number 11 of 2008 concerning Information and Electronic Transactions as amanded by Law Number 11 of 2024.
