Abstract

This research examines legal protection for business actors in online buying and selling using the Cash On Delivery (COD) payment method. The aim of this research is to determine the factors that cause consumers to default in online transactions using the Cash On Delivery (COD) payment method. As well as knowing and understanding the legal protection that business actors receive in online transactions via the Cash On Delivery (COD) payment method in the event of consumer default. This research method uses an empirical juridical approach. The results of this research explain that the factors that cause consumers to default are consumers' inability to pay, choosing the wrong goods, consumers not being at home and consumer specifications not being understood by consumers. The form of legal protection for business actors in online buying and selling using the Cash On Delivery (COD) payment method is: This legal protection can be seen in Article 1320 of the Civil Code which states that one of the conditions for the validity of an agreement is that it requires "the agreement of those who bind themselves" and that legal consequences occur. default or broken promise, namely the cancellation of the agreement according to article 1266 of the Civil Code which states "The default of one of the parties does not automatically terminate the agreement, but rather the termination of the agreement must be requested from a judge. And in article 6 of the Consumer Protection Law regarding the rights of business actors, such as the right to receive payment in accordance with the agreement, the right to sue for acts of consumer default.
